General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period during which the consumer may exercise the right of withdrawal.

  • Consumer: A natural person not acting in the course of a trade, business, or profession, who enters into a distance contract with the entrepreneur.

  • Day: A calendar day.

  • Duration transaction: A distance contract concerning a series of products and/or services, with delivery and/or purchase obligations spread over time.

  • Durable medium: Any device that allows the consumer or entrepreneur to store information in a way that enables future access and unaltered reproduction.

  • Right of withdrawal: The option for the consumer to cancel the distance contract within the cooling-off period.

  • Entrepreneur: The natural or legal person offering products and/or services remotely to consumers.

  • Distance contract: A contract concluded within a system for remote sales, organized by the entrepreneur, where exclusive use is made of remote communication means.

  • Means of remote communication: Tools that can be used to conclude an agreement without the consumer and entrepreneur being physically present at the same time.

  • General Terms and Conditions: These current General Terms and Conditions of the entrepreneur.

Article 2 – Applicability

  1. These terms and conditions apply to every offer by the entrepreneur and to every distance contract concluded between the entrepreneur and consumer.

  2. Before the distance contract is concluded, the consumer will be provided with the text of these terms and conditions. If not reasonably possible, the consumer will be informed where the terms can be accessed and that they will be sent free of charge upon request.

  3. If the contract is concluded electronically, the text of these terms will be provided in a way that allows easy storage on a durable medium. If not possible, the consumer will be informed where the terms can be viewed electronically and will be sent a copy upon request.

  4. If specific product or service conditions apply, the provisions of paragraphs 2 and 3 also apply. In case of conflicting provisions, the consumer may rely on the most favorable terms.

  5. If any provision of these terms is invalid or nullified, the rest of the agreement remains in effect, and the invalid provision shall be replaced by mutual agreement with a clause that closely reflects the original intent.

  6. Any situations not covered in these terms will be interpreted in the spirit of these terms.

  7. Ambiguities regarding the interpretation of these terms shall be interpreted in the spirit of the agreement.

Article 4 – The Offer

  1. If the offer has limited validity or is conditional, this will be clearly stated.

  2. Offers are non-binding and may be adjusted by the entrepreneur.

  3. The offer includes a complete and accurate description of the products/services. Images used represent the products truthfully. Obvious errors or mistakes do not bind the entrepreneur.

  4. All visuals and specifications are indicative and not grounds for compensation or contract dissolution.

  5. Product images reflect actual items, though exact color representation may vary.

  6. The offer will clearly outline the rights and obligations related to acceptance, including:

    • Price (excluding customs clearance and import VAT);

    • Shipping costs;

    • Method of contract conclusion and required steps;

    • Right of cancellation;

    • Payment, delivery, and fulfillment process;

    • Validity period of the offer;

    • Communication costs, if not based on the standard rate.

Article 5 – The Contract

  1. The contract is concluded once the consumer accepts the offer and meets the stated conditions.

  2. If accepted electronically, the entrepreneur will acknowledge receipt immediately. Until confirmed, the consumer may cancel the agreement.

  3. The entrepreneur ensures secure data transfer and a safe web environment, especially for electronic payments.

  4. The entrepreneur may assess the consumer’s ability to fulfill obligations. Based on findings, the entrepreneur may refuse an order or attach conditions with justification.

  5. Upon conclusion, the entrepreneur will provide the following:

    • Contact address for complaints;

    • Conditions and procedure for withdrawal;

    • Warranty and after-sales service information;

    • Contract-related information, unless previously provided;

    • Termination conditions for duration-based contracts.

  6. For duration transactions, the above information applies only to the first delivery.

  7. The contract is conditional upon the availability of the products ordered.

Article 6 – Right of Withdrawal

  1. The consumer may cancel the agreement within 14 days of receiving the product, without providing reasons.

  2. During the withdrawal period, the consumer must handle the product and packaging carefully, only using them as necessary to assess the product.

  3. To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing or via email within 14 days. After notification, the product must be returned within another 14 days. Proof of timely dispatch must be provided.

  4. If the consumer does not notify or return the product within the required timeframe, the purchase is final.

Article 7 – Costs in Case of Withdrawal

  1. The cost of returning products is borne by the consumer.

  2. Any amount paid by the consumer will be refunded by the entrepreneur within 14 days of withdrawal, provided the product is returned or proof of return is supplied.

  3. The entrepreneur may exclude the right of withdrawal for:

    • Custom-made or personalized items;

    • Items that are non-returnable by nature;

    • Perishable goods;

    • Price-volatile goods;

    • Newspapers, magazines;

    • Unsealed audio/video/software products;

    • Hygiene products with broken seals.

  4. The right of withdrawal may also be excluded for services related to:

    • Accommodation, transport, catering, or leisure on specific dates;

    • Services initiated with consumer consent before the withdrawal period ends;

    • Gambling or lottery services.

Article 8 – Price

  1. Prices will not increase during the offer validity, except due to VAT changes.

  2. Products subject to financial market fluctuations may have variable pricing, disclosed in the offer.

  3. Price increases within three months of contract conclusion are allowed only due to legal changes.

  4. Increases after three months require prior agreement and allow the consumer to cancel the contract.

  5. According to Section 5(1) of the Turnover Tax Act 1968, delivery outside the EU results in no VAT being charged by the entrepreneur.

  6. Typographical errors in pricing do not bind the entrepreneur. In such cases, the entrepreneur is not obligated to deliver the product at the incorrect price.

  7. Customs duties and import taxes are not included in prices and must be paid by the customer.

Article 9 – Conformity and Warranty

  1. The entrepreneur guarantees product conformity with the contract, offer specifications, reliability, and legal standards.

  2. Additional warranties from the manufacturer or importer do not affect consumer statutory rights.

  3. Defective or incorrectly delivered items must be reported in writing within 14 days and returned in original packaging and condition.

  4. Warranty is void if:

    • The consumer or third parties altered the product;

    • Products were mishandled or used against instructions;

    • Defects arise from regulatory requirements on materials used.

Article 10 – Delivery and Execution

  1. Orders will be handled with care.

  2. Delivery takes place at the address provided by the consumer.

  3. Orders will be fulfilled within 30 days unless a longer period was agreed. Delays will be communicated, and the consumer may cancel without charge.

  4. Upon cancellation, the entrepreneur will refund payments within 14 days.

  5. If delivery is impossible, the entrepreneur may send a replacement product, which will be clearly indicated. Right of withdrawal still applies.

  6. The entrepreneur bears the risk of damage/loss until delivery to the consumer or their designated representative.

Article 11 – Duration Transactions: Termination and Renewal

Termination

  1. The consumer may terminate an indefinite contract for the regular delivery of goods/services at any time with no more than one month's notice.

  2. Termination must be possible in the same manner the contract was concluded.

  3. The same notice period applies to both consumer and entrepreneur.

Renewal

  1. Fixed-term contracts may not be automatically renewed.

  2. Exception: Fixed-term contracts for regular delivery of newspapers/magazines may be extended once for up to three months, with a one-month termination option.

  3. Indefinite renewal is only valid if the consumer can terminate at any time with a one-month notice (or three months for less frequent deliveries).
